The ground rules for using this website and working with My Marketing Cure, written so you can actually read them.
By using mymarketingcure.com, submitting a form, booking a diagnosis, or engaging My Marketing Cure ("we", "us", "our") for services, you agree to these Terms & Conditions. If you don't agree, please don't use the site or our services.
If you're agreeing on behalf of a company, you confirm you have the authority to bind that company.
Where you sign a separate proposal, scope of work, or service agreement with us, that document governs the specific work. These terms fill in anything it doesn't cover; if the two conflict, the signed document wins.
We provide marketing consulting and related services to business owners, which may include strategy, digital marketing, direct mail, ecommerce, and lead generation, as described in your proposal.
Your initial diagnosis is free and carries no obligation on either side. It's a conversation and a recommendation. It doesn't create an ongoing engagement, and nothing is billed unless and until you accept a written proposal.
We deliver what's written in your accepted proposal. Anything outside it is a new scope, quoted separately and agreed in writing before we start.
Good marketing needs a working partnership. You agree to:
Delays in approvals or access will shift timelines, and we can't be responsible for results lost to them.
We bring 40+ years of experience and honest advice. What we can't do is promise numbers.
Marketing outcomes depend on your market, offer, pricing, staff, capacity, competition, budget, and how consistently the plan is followed. We do not guarantee specific results: rankings, leads, sales, revenue, or return on spend. Examples, case studies, and past client results shown on this site are illustrative of what those businesses achieved, not a prediction of what you will.
Nothing on this site or in our recommendations is legal, tax, accounting, or financial advice. Use your own professionals for that.
On full payment, you own the final deliverables produced specifically for you (campaign copy, creative, and plans) for use in your business.
We keep ownership of our own methods, frameworks, templates, tools, and any pre-existing or general-purpose materials, plus everything on this website. You may not resell, relicense, or redistribute our frameworks or templates.
We may reference our work for you and show non-confidential samples and results as part of our portfolio, unless you ask us in writing not to.
Each of us will keep the other's non-public business information confidential and use it only for the engagement.
You may browse this site and use it to contact us. You may not:
We may link to third-party sites and tools we don't control, and we're not responsible for their content or practices. How we handle your information is covered in our Privacy Policy.
Unless your proposal says otherwise, either of us may end an ongoing engagement with 30 days' written notice. You'll be invoiced for work performed and costs committed up to the end date.
We may end an engagement immediately if fees stay unpaid, if we're asked to do something unlawful or deceptive, or if the working relationship becomes untenable.
On termination we'll hand back your accounts and provide the deliverables you've paid for.
This site and our services are provided on an "as is" and "as available" basis. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent the law allows, My Marketing Cure will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, even if we were told they were possible.
Our total liability for any claim relating to the services is limited to the fees you paid us in the three months before the claim arose.
You agree to indemnify us against claims arising from content or data you supplied, from your products and services, or from your breach of these terms.
Neither of us is liable for delays caused by events outside our reasonable control.
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Collin County, Texas, and we each consent to that venue.
We may update these terms from time to time. The effective date above shows the current version, and continuing to use the site or our services means you accept the update.
If any provision is found unenforceable, the rest stays in force.
